Bmi Website Music Performance Agreement

*This excludes ASCAP music controlled by companies or individuals who have entered into direct agreements with YouTube. A BMI Music Performance license grants companies the right to publicly perform music associated with BMI. With an agreement, BMI offers unlimited access to more than 17 million musical works by more than 1.1 million BMI-affiliated songwriters, composers and music publishers. A website and/or mobile app that publicly performs music can save time and money by signing an agreement with BMI, rather than negotiating individual agreements with each music author and/or publisher whose music they wish to use. BMI offers flexible licensing options for websites and/or mobile applications that take into account the diversity and development of business models on the Internet. On behalf of our affiliated songwriters, composers and music publishers, BMI licenses all types of companies, including websites, to publicly perform the more than 17 million works in the BMI repertoire. When ASCAP music is identified in a video, Content ID automatically makes a claim on behalf of ASCAP members. If you are an ASCAP member and an ASCAP claim is made for a video with music you own, the royalties charged on that claim will be distributed to you and (if applicable) to other ASCAP songwriters and publishers who are co-owners of the music, subject to ASCAP`s investigation and distribution rules. BMI TV, cinema, theatre and classical composers are all successful. Bmi legends such as Mike Post of “NYPD Blue”, the celebrity or Ed Kalehoff, who wrote the first part of “Monday Night Football”, Charlie Fox, who wrote many tv hits, including “Happy Days”, and WG Snuffy Walden, whose first big theme was for “ThirtySomething”, are a small selection of composers represented by BMI. BMI also represents the principal composers of many of the highest-grossing films of all time, including E.T., Jurassic Park, Star Wars, set to music by John Williams, and “The Lion King” with songs by Elton John and Tim Rice. To distribute performance royalties to songwriters and publishers whose music you use, BMI will ask you for information about the musical performances of your service.

You will be asked to identify the music (by song title, artist, etc.) that is or was available on your service and submit statistics that show the performance volume of that music. Separate financial and music usage reports, as well as separate payments, including minimum fee payments, are required for each of your websites and/or mobile applications listed in Appendix A of your contract. Websites and apps on different platforms (iOS, Android, Roku, etc.) with the same features are treated as a single service for payment and reporting purposes. Each digital license agreement has a minimum annual fee. This fee for 2020 is $381.00 and is refundable for all fees charged up to that amount. Any fees above the minimum depend on a variety of factors, including but not limited to business type, revenue, and traffic (see section 4 of the applicable license type for more information). You submit financial reporting forms that set the appropriate fees for each reporting period. The exclusive right of the copyright owner, granted by U.S. copyright law, to authorize the performance or transmission of the work to the public. ASCAP will generally not ask YouTube to block a video without the express request of one of the ASCAP members, but it is fully within the right of our members to ask us to block a video that uses their music without permission. Keep in mind that the music you use can be represented by multiple parties such as publishers, labels, or PROs – if your video is blocked, it`s possible that the request isn`t from ASCAP.

Songwriters and publishers also receive mechanical license payments. A mechanical license is a written permission from the publisher to produce and distribute a disc, CD, or tape for a specific copyrighted composition. The amount of royalty paid to a songwriter from a mechanical license depends on the number of recordings sold. BMI does not license things like making discs or printing sheet music. Many websites and/or mobile apps base their activity on the use of music, while others offer them as a complement or complement to the rest of the content of their service. BMI offers multiple licensing options in recognition of the diverse and evolving nature of digital businesses. The different pricing calculations ensure that a reasonable value is given to your particular use of the music. ASCAP represents the public performance rights of more than 775,000 songwriters, composers and music publishers. YouTube pays ASCAP a royalty for the right to feature its members` music in YouTube videos*. We then distribute these fees in the form of royalties to ASCAP members. ASCAP operates on a not-for-profit basis and distributes all royalties we collect to our songwriters, composers and publishers who are members, less our operating costs. We distribute 88 cents of every dollar we collect to our members in the form of royalties.

If you have added music that is part of our music repertoire of more than 11.5 works to your video, you may receive a notification that we are making a copyright claim on your video on behalf of our members so that they can earn their performance royalties. However, before clicking on the “Download” button, you should keep in mind that there is a songwriter or composer who created it, who depends on the income from all the different uses of his music for his livelihood. Remember that each time you upload a video, you agree to YouTube`s Terms of Service, including the part that states that “you own or have the necessary licenses, rights, consents, and permissions to post the content you submit.” It also means music. There are many variations of audiovisual programming, including but not limited to; Television, cinema, documentaries, fitness services, music lessons, games, sports/news/discussions and social apps. BMI has licenses for performance licenses for all types of audiovisual services. “Podcasting is the latest wave of online music. BMI offers a new media license that unlocks public performance rights for thousands of businesses and individuals with simple and cost-effective licensing options. BMI`s agreement only applies ™to public performance rights in musical works in BMI`s repertoire. You must obtain additional licenses from music publishers and record companies for mechanical rights to the underlying musical works and for the use of master sound recordings in your podcast. “Your royalties go to the songwriters, composers and music publishers who create the music you play. BMI acts as a non-profit organization. All funds received, less operating costs, are paid in the form of royalties to songwriters, composers and publishers. Last year, nearly 90% of every BMI generated was returned to the creative community.
